Health &safety offences, corporate manslaughter, food safety and hygiene offences sentencing guidelines consultation

The Sentencing Council is seeking views on the review of these guidelines:

  • the scope of each guideline;
  • the overall approach proposed to sentencing organisations and individuals for these offences; factors that make these offences more or less serious;
  • the principles of sentencing in this area;
  • the sentences that should be passed for health and safety, corporate manslaughter and food safety offences; and
  • anything else that you think should be considered

The consultation applies to:

  • health and safety offences – organisations;
  • health and safety offences – individuals;
  • corporate manslaughter;
  • food hygiene and food safety offences – organisations; and
  • food hygiene and food safety offences – individuals.

What is important, and what is less so? What is the likely impact in your own organisation, of a health & safety offence and its likely sentencing, of individuals and of the body corporate ie, the directors and others deemed to have a key organisational responsibility and others who may be hands off but otherwise listed as directors/

Accidents and other H&S issues are regrettably common in the waste sector. With healthcare wastes, the possibility of infection or sharps injury, even without infection, increases the possibility for prosecution. This increases still further if there is a pattern of incidents or incidents coming to light retrospectively that had not been reported, investigated and properly managed at the time.
