Technical proposal for the review of hazardous properties

The assessment of the ‘hazardousness’ of wastes is done based on

  1. Decision 2000/532/EC on the List of Waste (LOW) and
  2. Annex III to Directive 2008/98/EC on waste, which defines the properties that render wastes hazardous

Both pieces of legislation are currently under review. Intended as the basis for a legislative proposal, the European Commission are inviting stakeholders to provide comments to the EU Technical paper by 29 May at the latest.

Comments may concern the options presented in the technical paper, as well as practical implications for selected waste streams. Comments regarding specific waste streams and particularly waste streams currently classified as hazardous that may be classified as non-hazardous (and vice-versa) due to changes in the chemicals legislation are also appreciated. In this case, it is recommended to apply the same structure as in the document on implications for some wastes from thermal processes.
