Defra is asking for feedback on new regulations for handling, transferring and transporting waste in England and Wales. If you want to comment on the proposals, you need to do so by 8 September.

The new Waste Controls Regulations are due to come into force in April 2009.

What are the proposals?

This consultation applies to England and Wales only. It incorporates responses to three earlier consultations, and includes draft regulations and a partial impact assessment.

The new Waste Controls (England and Wales) Regulations 2009 will replace several pieces of existing legislation with one consolidated regulation.

The new regulations:

• simplify the existing waste regulations and make them more effective.
• require waste brokers and dealers to register with the Environment Agency
• set out requirements for transfer notes
• control the seizure of vehicles by regulatory authorities

Consultation questions

The consultation asks whether:

• all waste carriers should be required to register with the Environment Agency, including those carrying their own waste
• the proposal to divide carrier registrations into upper and lower tiers is fair
• the proposed ‘disc’ system of proof of carrier registration is acceptable
• the creation of new offences (such as failing to report changes in registration details) will assist in enforcement
• the duty of care should be extended to include those involved in exporting waste
• the proposal to increase the maximum level of fines and make more use of fixed penalty notices will help in enforcing the regulations.

Who will the new regulations affect?

The proposals will affect businesses that:

• produce waste
• import waste
• carry or transport waste
• keep or store waste
• treat waste
• dispose of waste
• operate as waste brokers or dealers.

This means that the proposals will affect most businesses. In particular they will affect the waste management industry and farmers.
