A woman cannot collect damages after the Oakland County medical examiner removed her mother's brain during an autopsy, but did not return it with the remains, a federal appeals court panel ruled Wednesday.

"The medical examiner performed an autopsy as part of the investigation into the death and removed the brain to examine it before returning the rest of the remains to Waeschle, who had the body cremated.

"Waeschle learned weeks later in a meeting with an assistant medical examiner that her mother's brain had been incinerated as medical waste.

Strange isn't it, that to incinerate an entire body is OK, but the same incineration process done in two parts, is somehow abhorrent and needs a lawsuit. In this case, common sense prevailed and the case was lost
